TERMS AND CONDITIONS

Holiday Rental Confirmation: The completion of the booking form shall form the acceptance of all of the following terms and conditions of the rental between the owners and the clients. A contract for rental for the periods requested shall only be made upon confirmation being given as to the receipt by the owners of a fully completed booking form together with the appropriate payment, and availability confirmed. The client undertaking the booking and rental contract and signatory to the booking form must be at least 21 years of age and contract with the authority of all members of the rental party. Everyone occupying the property must be listed on the booking form, including children of all ages. This is a Florida State law and must be adhered to. Any unauthorized occupancy by people not listed on the booking form will result in immediate termination of the rental agreement. The villa cannot be shared or sub-let and only the persons shown on the booking form are permitted to stay in the villa.

Security Deposit: A Security deposit of one weeks rent is required for all bookings and is payable upon booking and should be sent with the completed booking form. If booking the villa within 8 weeks of the start of the holiday then the full amount of the rental cost, and security deposit will be required upon booking. The client undertaking the booking will be held as principal responsible for all payments due and payable in respect of the holiday and booking. The security deposit will be repaid to the client undertaking the booking within 28 days of the end of the rental period. The security deposit will be refunded following an inspection of the villa by the local Management Company at the end of the booking period. The security deposit is security against the cost of damage, theft, breakages, excess cleaning costs to any part of the villa or it's contents, lost keys, unpaid fees, cancellations and misadventure of any nature. Any such deductions will be at the absolute discretion of the owners following the local Management Companies report. The assessment of loss and damage etc. by the local Management Company shall be final and binding upon all parties. In the event of the assessed costs of damage / loss etc. exceeding the deposit amount in total or part then such sum in excess of the security deposit shall be due and payable within 14 days.

Final Rental Payment: The balance of the rental payment must be paid no later than 8 weeks of the start of the rental period. A full invoice will be sent. Failure to pay the final rental payment by the date requested or later than 8 weeks prior to the start of the rental period will entitle us to cancel the booking without notice. Cancellation charges will apply. The pool heating charge must be paid with the final payment.

Local Management Company: You will be advised of the name, address and contact number of the local Management Company. All loss and damage should be reported to them immediately. The local Management Company will be able to undertake necessary repairs and replace items wherever necessary.

Villa Care: Our objective is to provide to you a modern fully equipped holiday villa, in a pleasant environment and suitable for a family and or groups of adults. We aim to provide furnishings and equipment to a high standard to enable you to enjoy your holiday accommodation. So that we can maintain this high standard we ask the following - All visitors and guests to the villa should treat the villa, its furnishings and contents with proper care. No contents should be removed from the villa. Soft furnishings should not be removed to the swimming pool area. The villa should be left in a clean and tidy condition at the end of the rental period. In the event that any item is noticed to be damaged or below standard then please inform the local Management Company so that action can be taken if necessary. This will assist us maintain our high standards for the next guests and hopefully secure your desire to return to our villa in future years.

Cancellation: Any cancellation by the client must be confirmed in writing by the lead client. The following cancellation charges shall apply -
- More than 8 weeks notice of Cancellation - Deposit Only
- Between 6 and 8 weeks notice of Cancellation - 50% of Rental Cost
- Between 4 and 6 weeks notice of Cancellation - 75% of Rental Cost
- Less than 4 weeks notice of Cancellation - Full Rental Cost remains payable

In the event that we are able to re-rent the villa for the same period as the rental booking (without reduction) then we shall make an ex-gratia repayment of up to 50% of the cancellation charge. However, all cancellation charges will remain payable.

Arrivals: The villa will be available for occupancy from 4:00 pm on the day of arrival. We will confirm with you the Lock Box Number for the key in our Pre-Holiday Information Pack.

Departure: Departure from the villa must be no later than 11:00 am on the departure date. Should you decide, prior to your departure date, to extend your stay, please notify the local Management Company immediately. It may be possible to remain in the villa or the local Management Company may be able to accommodate you in another villa. Cleaning staff will have been scheduled to arrive to ready the villa for the incoming guests and are unable to commence work until the outgoing guests have departed. Failure to notify the local Management Company of a late departure, a charge of $75.00 plus tax will be charged to the security deposit.

Insurance: Travel and holiday insurance arrangements remain the responsibility of the clients and persons traveling and occupying the villa. It is a condition of the acceptance of the booking that adequate travel and holiday insurance is obtained at the time of booking. The insurance should cover normal insurable risks including cancellations, medical, repatriation, third party etc.

Changes to booking or cancellation by the property owners: The owners accept no liability or responsibility for any loss, damage or inconvenience caused or occasioned by changes or cancellation to the rental period or duration caused by events and occurrences beyond the owner's control or reasonable contemplation, including but not limited to war, civil commotion, links and transfers, delays or cancellations, flight cancellations or alterations, airport closure or delay, weather conditions, fire, flood, disease, industrial dispute or failure of public utilities of any sort.

Changes to booking by client: Any changes requested by the clients in respect of the booking shall be permitted only in the absolute discretion of the owners whose decision shall be final. Refusal to agree to changes shall not be a basis for cancellation by the clients. Any changes requested to the rental dates shall always be subject to availability. All changes shall incur an administration fee of £25.00 ($40.00) payable within 7 days of the request and in any event before commencement of the holiday rental.

Limitations of Liability: The Owners or Owners Agents do not accept any liability whatsoever for the death, personal injury, sickness, accident or delay or loss of luggage or personal effects or any other loss, theft or misadventure which may occur during the rental period. All belongings, goods, items of any nature are left at the full risk of the guests. All children must be properly supervised at all times within the pool area. Use of the pool and other leisure facilities is entirely at the client's risk. The Pre-Holiday Information Guide includes "Pool Rules" which must be complied with. The Owners and Owners Agents do not accept any liability whatsoever for any local area neighbourhood or surrounding or intermittent social or environmental, geographical or atmospherically occurring factors, conditions, effects or circumstances of any nature whatsoever or howsoever caused or effected. The Owners or Owners Agents are under no obligation or requirements to give any such notice or information in respect of any of the above mentioned matters howsoever or whensoever informed or known.

Code of Conduct: All clients shall behave reasonable and responsibly. Proper consideration shall be given to the other persons and occupiers within the locality. The locality is a residential area and therefore proper control and consideration should be employed at all times. Excessive noise of any sort shall not be permitted at any time of day or night. In the event of any client behaving in such a manner as to cause, or be likely to cause danger, nuisance, annoyance or distress to any other party or occupant / neighbour or to cause or be likely to cause and damage to the villa or any other property then we reserve the right to immediately terminate the villa rental. Our local Management Company shall have full authority to exercise their own views upon these issues and their decision shall be final. In the event of the rental being terminated, then all of our responsibilities and liabilities in respect of the rental shall cease immediately and we shall not be liable for any costs incurred or for compensation or refund of any costs or losses. The local Management Company shall in there absolute discretion request assistance of local policing and emergency services.

Complaint: In the unlikely event of a problem arising whilst staying at the villa, our local Management Company should be contacted who will seek to resolve the matter. Your satisfaction is paramount and should you consider that the matter is of a serious nature, we ask that you contact us within 14 days of your departure from the villa. However, if the problem has not been reported to the local Management Company then we cannot accept any responsibility.

Other General Conditions We maintain an absolute "No Smoking" policy in all areas inside the villa. However, smoking is permitted in the patio area, where ashtrays have been provided. In the event that neutralization of smoke odours from cigarettes, cigars, pipes or other smoking materials is required, or in the event that burn marks from cigarettes, cigars, pipes or other smoking materials are detected, the cost for elimination of these odours or repair of the burn marks will be deducted from the security deposit.
- No pets are allowed.
- No all male parties or parties of guests who are under the age of 21 will be accepted.
- A Cleaning Charge of £50.00 ($80.00) will be charged for stays of less than 6 nights.
- All rates are subject to change until final confirmation of booking.
- Florida has a sub tropical climate and care must be taken with food that is left uncovered. Uncovered food can attract insects very quickly. Any added cost for pest control services incurred for lack of care maybe deducted from the security deposit.
- To comply with Florida State fire regulations, under no circumstances may more than the maximum number of persons identified on the booking form occupy the villa.
- The owner and the local Management Company reserve the right of entry at any time, which includes pool maintenance staff, gardeners etc.
- All Towels provided are for use in the Villa only and not to be removed from the Villa.

Law: All parties agree that the contract and booking terms and conditions shall be governed by and interpreted in accordance with the laws and procedures of England and the parties hereto agree to submit themselves to the jurisdiction of the Courts of England in the event of any dispute.

Privacy: Any information passed on by visitors to this site, for example, clients completing booking forms or submitting their e-mail address will be used solely for the purpose of renting the villa. We will not pass your details on to any other agencies or third parties whatsoever and will at all times respect the privacy of our clients.
